1. Who you are contracting with
Ghost Text ("the Service") is provided by DSean Hall, a sole proprietor trading as Ghost Text ("we", "us"). By using the Service you ("user", "you") agree to these Terms. If you do not agree, do not use the Service. You must be at least 16 years old, or the age of digital consent in your country, to use Ghost Text.
2. The Service
Ghost Text is an AI-assisted writing aid that analyzes text conversations (typed or via screenshot) and suggests replies, tone adjustments, and contextual interpretations. The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation.
3. Acceptable use
You must not:
- use the Service for any unlawful purpose;
- commit fraud, send spam, or impersonate others;
- generate content to harass, threaten, manipulate, deceive, gaslight, stalk, or coerce another person;
- generate sexual content involving minors or non-consensual content of any kind;
- infringe intellectual-property or privacy rights;
- upload malware, probe, scan, or otherwise interfere with the security of the Service;
- scrape, mirror, or resell the Service or its outputs;
- reverse engineer or circumvent technical limits or rate limits.
4. AI outputs — your responsibility
The Service uses third-party AI models. Outputs may be inaccurate, biased, or inappropriate. You are solely responsible for reviewing outputs before sending, sharing, or acting on them. Ghost Text is not a substitute for legal, medical, financial, or mental-health advice. You are responsible for ensuring you have the right to upload any content (including screenshots of conversations) and for how you use any output.
5. Intellectual property
All software, branding, designs, and documentation comprising the Service are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain ownership of the content you upload; you grant us a limited license to process it solely to provide the Service.
6. Payment, subscriptions, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellations, and refunds are governed by Paddle's Buyer Terms and Paddle's Refund Policy, in addition to our own Refund Policy. Subscriptions renew automatically at the end of each billing period until cancelled.
7. Suspension and termination
We may suspend or terminate your access to the Service, with or without notice, in case of: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time; you may cancel a Pro subscription via the customer portal.
8. Warranty disclaimer
To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid to Paddle for the Service in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence where such exclusion is prohibited by law.
10. Indemnity
You agree to indemnify us against any claims arising from your content, your unlawful or unauthorized use of the Service, or your violation of these Terms.
11. Changes
We may update these Terms. Material changes will be communicated in-app or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Disputes will be resolved by the state or federal courts located in California, except where mandatory consumer-protection laws of your country of residence provide otherwise.
